AIR FACTORY® E-liquids – PMTA Update

You are no doubt aware of the recent legislative changes that expanded the definition of “tobacco products” to include products made with synthetic nicotine. This e-mail is to update you on plans for the wide variety of quality AIR FACTORY® e-liquid products you and your customers love—including tobacco, menthol, and other flavors like Blue Razz, Mystery, and Wild Apple—including plans for premarket tobacco product applications (PMTAs) for AIR FACTORY® products.

AIR FACTORY® Synthetic Nicotine Products
AIR FACTORY® e-liquids come in a range of formulations using synthetic nicotine in 100mL 60mL, and 30mL (salts) options. Under the new legislation, ENDS manufacturers of synthetic nicotine products that were on the market as of April 14, 2022 must submit PMTAs to the U.S. Food and Drug Association (FDA) for the products by May 14, 2022, and ultimately obtain authorization from FDA to market the products.

AIR FACTORY® Tobacco-derived Nicotine Products
The popular and time-tested AIR FACTORY® 60mL and 30mL (salts) tobacco-derived e-liquids are also under FDA PMTA review. While the AIR FACTORY® tobacco-derived flavored e-liquids were subject to an MDO in September 2021, FDA subsequently issued an administrative stay of the MDO and a stay of enforcement.

All AIR FACTORY® tobacco-derived e-liquids listed on the www.airfactoryeliquid.com website can continue to be marketed and sold.
